100 Days Of Heat – Enforcing Colorado DUI Laws

Denver is a great place to be in the summer, unless you plan to drink and drive.  Colorado state law enforcement agencies are already more than halfway through this summer’s 100 Days of Heat campaign and have made more than 800 drunk driving arrests.

This program consists of increased DUI patrols and sobriety checkpoints throughout the state between Memorial Day weekend and Labor Day.  This period of increased vigilance is in response to the knowledge that one third of all alcohol-related fatalities occurring in Colorado last year took place between these two major summer holidays.

Drunk driving is a serious offense in the state of Colorado.  If you have been arrested for a drunk driving related offense in the Denver area, you should seek the advice of a qualified DUI attorney as quickly as possible.

The consequences for a DUI in the state of Colorado are severe, even for first time offenders.  If convicted of a drunk driving offense, the driver may face significant fines, required community service, mandatory alcohol education classes, the suspension of their license, and potentially even jail time. The state of Colorado has estimated that the cost to the driver for a DUI case is at least $8,866.

There are two different types of drunk driving charges in the state of Colorado:  DWAI and DUI.  Driving While Ability Impaired (DWAI) is used when a driver is pulled over and has a blood alcohol content (BAC) between .05 and .07999, while Driving Under the Influence (DUI) is used when a driver has a BAC of .08 or higher. The legal limit for intoxication in most states is .08, so the Colorado limit is significantly lower at .05.  Both charges are criminal offenses.

When a driver is charged with either DWAI or DUI, there are actually two different cases against them.  There is the criminal case for DWAI/DUI and a separate civil case regarding the suspension of the defendant’s driver’s license.

As you can see, a DWAI/DUI case in Colorado includes a complex process of legal procedures, and the consequences can have a far-reaching impact on both the driver and their family.  If you have been arrested for a DWAI/DUI in Denver, it is imperative that you find an experienced DUI attorney to help you identify your options and determine what will work best for you.
