Rising Curve Defense

Definition of Rising Curve Defense

Rising curve defense is also referred to as rising alcohol defense and is based on the DUI defense that a driver was not under the influence of alcohol and did not have a BAC or blood alcohol concentration of 0.08% or higher at the time they were driving, but that their BAC rose to that level after their arrest due to the absorption rate of alcohol.
