Definition of Judge

Like the DUI defense attorney and the DUI prosecuting attorney, the judge in a DUI trial has specific roles and responsibilities in a DUI case. It is the judge who presides over the court. The judge's role is not to advocate for the state, like the prosecuting attorney, or to advocate for the defendant, like the DUI defense lawyer, but rather to be impartial. The judge also has the responsibility to review the DUI evidence against the defendant and determine what evidence is admissible in court. Most DUI cases are bench cases, unless the defendant demands a jury trial.
