If you have been arrested for DUI you may have expected to be read your Miranda Rights. Miranda rights should be read to a DUI suspect when they are placed under arrest and prior to their interrogation. The Miranda warning is not a condition of detention, but rather a safeguard against self-incrimination; so if the officer does not plan to interrogate you, he may decide there is no reason for you to understand your rights during questioning.
Keep in mind however, that if a police officer does arrest you and begins their interrogation without reading you your rights, you can hire a DUI lawyer and they can review the DUI arrest and make sure that anything you said during the interrogation is excluded from evidence.
That raises another question…what if you say something incriminating prior to your DUI arrest and prior to hearing your Miranda Rights? Unfortunately, if you do this, the information you provide to the officer can be added to the DUI arrest report and used at both your DMV Hearing and your DUI trial.
Keep in mind, if you are stopped for a DUI, it is best to keep your mouth shut.
