How does my DUI affect my right to drive in Georgia
How does my DUI affect my right to drive in Georgia
Unfortunately, you did not mention whether or not this was your first, second or third DUI arrest. I will assume it is your first DUI arrest.
A DUI is a misdemeanor. Once you are arrested for DUI, the prosecutor has two years in which to file charges with the Clerk of Court. If charges are not filed with the Clerk within the statute of limitations, the case will be dismissed.
Unfortunately, in the state of Georgia, a DUI will stay on your driving record for life. It is impossible to say what the long-term effects could be for your DUI conviction. Some drivers may have restrictions placed on their jobs or their ability to obtain credit or they may have their car insurance cancelled.
In addition, you will face the following DUI Penalties:
• Fines: $300 - $1,000
• Jail Term: 10 days - 1 year (the judge has discretion to stay, suspend, or probate the jail time). If you blood alcohol concentration (BAC) is .08 or higher, there is a mandatory minimum of 24 hours in jail.
• Community Service: 20 hours if your BAC is under 0.08%, 40 hours if BAC is higher than 0.08%
• Drivers License Suspension: 1 year suspension for drivers who are over the age of 21, although you may be allowed to get a work permit for the first 120 days and full reinstatement of your license after 120 days if you meet the requirements of your probation.
• Drug and Alcohol Educational program
