While there are numerous factors that can affect your sentence, the biggest factor is the number of DUI convictions you have on your record in the last 10 years.
If you have been arrested for DUI, Virginia courts will evaluate how many DUIs you have had on your record in the last 10 years. You said you have been charged with your second DUI in five years so if you are convicted, it will be considered a second DUI offense.
So what types of DUI penalties are you facing?
BAC 0.08-0.14 percent -Mandatory 20-day jail sentence.
BAC was 0.15-0.20 percent -Mandatory minimum jail sentence is 30 days.
BAC of 0.21 - Mandatory jail sentence increases to 40 days.
You can also expect to pay a minimum of $500 in fines and your VA license will be suspended for 3 years.
Will you be allowed to get a restricted license? Yes, after 12 months the courts may be willing to issue you a license which you can use to drive to school, work, the doctor’s office or your alcohol safety education course.
The court will also require that you get an Ignition interlock device installed on your car which will measure your blood alcohol concentration prior to allowing you to start your car and drive.
