This driver’s blood alcohol concentration was 0.10%, and they have been assigned a public defender. Updates have been made in 2006 as well as 2011, with the most recent amendments making it easier to receive jail time, even for first-time offenders. The legislature has also reduced the ability of the trial judge to impose penalties and sentences at their own discretion.
West Virginia implied consent laws require drivers to submit to a blood, breath or urine test if they are arrested for a West Virginia DUI. Under most conditions the officer can decide which test they will , but if they offer a blood test you may have the option to request a urine or breath test. Refusal to take the test will result in having your license suspended.
